EU: ‘Illegal Migrants in Morocco Have European Union Refugee Rights’

The European Court of Human Rights has made a landmark ruling that migrants who cross border fences which are still outside European Union territory have ‘rights as refugees’ – meaning Spanish authorities will no longer be allowed to return illegal immigrants to Morocco who storm border fences at the enclaves of Ceuta and Melilla.

The precedent was set following the ruling of two cases of illegal African migrants who were returned by Spanish border guards to Morocco after crossing the border fence in Melilla – despite the migrants technically still being in Moroccan territory at the time of their apprehension, reports Die Welt.

In the case of ‘N.D. and N.T. vs Spain’, the Strasbourg judges ruled in favour of two migrants from Mali and the Ivory Coast who were, on two occasions, directly arrested by the Spanish border police and handed over to Moroccan authorities at the Melilla border in 2014.

The judges condemned Spain for not giving the illegal immigrants access to lawyers or interpreters or allowing them to make complaints to Spain. The Court determined there was “no doubt” these actions amounted to ‘prohibited illegal deportations’, and both migrants were awarded €5,000.

The Spanish government argued that, amongst other considerations, the men had not yet reached any Spanish territory because the fences were still outside the exclave – an area the pro-migrant NGO European Center for Constitutional and Human Rights (ECCHR) that supported the case calls “a lawless zone of automatic expulsions”.

However, Strasbourg determined that as the Spanish police had de facto control in the border area, the standards of the European Convention on Human Rights (ECHR) also applied there.

The Court’s decision stated that Spain’s “push-back” practices at the Spanish-Moroccan border are in violation of Article 4 Protocol 4 (prohibition of collective expulsions) and Article 13 (right to an effective remedy) ECHR.

The ECCHR, which tried to bring charges against former Defense Secretary Donald Rumsfeld over detainee abuses at Abu Ghraib and Guantanamo Bay prisons in 2006, remarked that the litigation against Spain “has impact beyond the individual case”.

“It sets a precedent in order to assert the fundamental right to have rights of refugees and migrants,” said ECCHR General Secretary Wolfgang Kaleck, who acted as an attorney to American NSA leaker Edward Snowdon in 2015.

“The ECtHR [European Court of Human Rights] judgment clarifies that Spain’s border regime violates human rights, because the Convention also applies at the external borders of the EU,” Kaleck added.

This could mean that migrants will not only have EU human rights once on European soil, but in any territory where EU authorities have control in a border area.

The human rights NGO has also stated it has been taking similar litigation against what it calls “illegal push-backs” in Ceuta (another Spanish enclave bordering Morocco), Idomeni (at the Greek-Macedonian border), and reception centres in Greece.

Breitbart London has reported on the increasing violent migrants storming the Spanish enclaves en masse, with one incursion leading to 1,000 Africans attempting to break into the EU leaving 55 members of the Spanish and Moroccan forces being injured.

Mam nadzieje ze zanim EU zdechnie Polska wyssa z cycka UE tyle ze
nawet na +1000 starczy.
Dlaczego UE nie moze zrozumiec ze zwracanie polskich uchodzcow do PRL
to byla zbrodnia przeciwko ludzkosci, zas niezwracanie uchodzcow
ciapatych do Afryki to kompletne niezrozumienie nauki Jezusa Chrystusa
o dobrym Samarytanie.

EU is on the BRINK: Forget May, Europe's states are weak and CHAOTIC, says ROSS CLARK

THE view that Theresa May is a beleaguered Prime Minister took a huge knock yesterday with the news that Angela Merkel's position as German Chancellor is on the brink.

You think that Mrs May is struggling to hold her Government together? Mrs Merkel has spent nearly two months trying to put together a viable administration, and she can't do it.

The Christian Social Union, which was to be part of her coalition, wanted a cap of 200,000 refugees a year – in contrast to the million migrants who arrived in a few months in 2015 after Mrs Merkel threw open Germany's doors. But the Greens insisted on a more liberal migration policy.

The Greens demanded an end to coal power – which Germany has come to rely upon even more after Merkel committed her country to a panic exit from nuclear power in the wake of the 2011 Fukushima nuclear disaster in Japan. The pro-business Free Democratic Party, on the other hand, wanted to put jobs and economic growth above cuts in carbon emissions.

The most likely outcome is for fresh elections that could throw Germany into even more uncertainty, possibly giving a boost to the anti-migrant party Alternative for Deutschland (AfD), which finished third in September's elections.

By comparison, Mrs May's deal with the DUP has held steady in spite of many predictions of disaster. Her popularity has increased slightly since the Westminster groping scandal – not all that surprisingly, perhaps, since it has afflicted Labour as much as the Tories.

I suspect there is another reason, too, for Mrs May’s slight recovery. It is becoming increasingly clear to the British public, whichever way they voted in the referendum, that it is the EU's intransigence that has led to the lack of progress in Brexit negotiations. They could see that the Prime Minister made an important concession in her Florence speech by offering to pay a £18billion leaving bill, yet the EU still refused to start trade talks.

To any reasonable outsider, the EU's treatment of Mrs May is beginning to look like attempted bullying. If Frau Merkel does leave office it will have significant implications for the Brexit process, because she has had a big hand in the EU's strategy against Britain. She opposed granting David Cameron any meaningful reforms ahead of the referendum – reforms that could have swung Britain towards a Remain vote.

Immediately after the referendum, she made a speech insisting that Britain couldn't enjoy any privileges of the single market unless we paid full dues and obeyed all rules without receiving any say in how those rules were made. Many Remainers still cling to the fantasy that we could remain in the single market while outside the EU, but Frau Merkel ruled it out from day one.

Frau Merkel has also been the driver of the EU's policy of refusing to discuss a trade deal until Britain has put a large sum of money on the table. She has done so in spite of the knowledge that a "no deal" Brexit would affect relations with Germany's third largest export market. In 2016, Germany exported £76billion worth of goods and services to Britain.

There was always going to come a point at which German industrialists started to question the wisdom of Merkel's approach, asking whether she really wants to compromise her country's economy just in order to be seen to score a political victory against Britain?

Sure enough, last week a group of business leaders launched a campaign called New Deal for Britain, appealing to the EU to grant Britain the concessions it should have done when David Cameron was renegotiating our relationship with the EU. Britain, claim the business leaders, has proved to be Germany's chief ally when it comes to standing up against EU directives that could compromise competitiveness.

They are trying to lobby EU leaders to persuade them to offer Britain a new kind of EU membership, which would exclude free movement. The group would really like Britain to stay in the EU with its own bespoke deal. It is too late for that, but May should take the opportunity to reach out to German businesses and make common cause for a trade deal.

The Prime Minister must strike now, while Merkel is at her weakest, and make a statesmanlike appeal for free trade. If she can get trade talks moving, without giving in to ludicrous demands for money, she will enhance her reputation.

WHO knows, Theresa May might even come to replace Angela Merkel as Europe's strong woman. There aren't many other European leaders who can claim dominance over her. France's Emmanuel Macron is deeply unpopular after only six months in power. Spain's Mariano Rajoy has been damaged by his handling of the Catalan crisis.

Italy's PM, Paolo Gentiloni, is struggling to keep his own coalition intact and lacks a personal mandate, having been appointed after his predecessor's resignation last December. There are weak and chaotic governments all over Europe.

There is no reason why Theresa May and her ministers should feel in an inferior position at the EU negotiating table and every reason why they should continue to press for what so many people across Europe want – a grownup, free trading relationship between Britain and the EU once we have left.
